SIA «KIMKO LV» (hereinafter “we”) respects your privacy and is committed to protect it through compliance with this privacy policy (hereinafter the “Privacy policy”). In this Privacy policy we will inform you about our processing of your personal data. We commit ourselves to be transparent with you by providing clear information about what personal data we process, the purpose of processing, the retention period of the personal data as well as the legal basis for the processing and other information that we are required to provide pursuant to applicable legislation.

  1. WHAT PERSONAL DATA DO WE PROCESS AND WHY
  2. Having created an KIMKO account on our website, use the e-store services or agree to receive direct marketing in our web-page, you provide personal data that we will process. The categories of personal data that we process about you, purposes and legal basis for the processing are the following:

    1.1 KIMKO account (registration and administration)

    Categories of personal data: E-mail, name, surname, phone, password (encrypted), a list of favourite goods (goods, price, date), action within the KIMKO account, including technical data (log-in information, for instance, the last time you logged in), information which you provide when ordering direct marketing as specified in Paragraph 1.4 (if you have ordered/subscribed); details of e-mails, for example, when you create an KIMKO account on the website, we are sending confirmation e-mail, or when you request to remind the forgotten password.

    Legal basis for the processing: Your consent which is deemed given when you activate your account.

    You can create your KIMKO account on our website. In such case we will process your data so as to provide you with the opportunity to create an account to be able to use it for taking advantage of services offered to registered users including e-store services for the purpose of administration and maintenance, also to recognise you when you lodge inquiries, to notify you of any changes in the terms and conditions of the account (Privacy policy, changes in terms and conditions, etc.) or to contact you in emergencies (in case of any problems with regard to the account, in case some items are lost, etc.). We also process your certain data for the statistical purposes as described in Paragraph 1.3.
    In your KIMKO account, you can see what your personal data is processed by us, edit information about yourself, change the settings with regard to direct marketing and use e-store services as described in paragraph 1.2.
    By registering KIMKO account you approve that you are at least 18 years of age and your personal data are accurate and correct. In cases of inaccuracies you should immediately correct them.

    1.2 E-Store

    Categories of personal data: E-mail, name, surname, telephone, lists of goods (name, date, goods, amount), address(es) of delivery (if the delivery service is chosen) and settlement, place of collection of the goods, list of orders (order No, date of the order, goods, number of goods, date of delivery, order fulfilment date, amount (price of the goods and allowed discounts), payment details, payment documents (VAT invoice etc.), signature in the document of transfer and acceptance of the goods, e-correspondence details, information on return.

    Legal basis for the processing: Conclusion and performance of a contract with you.

    If you create your KIMKO account on our website, you can use the e-store services. In this case, for the purposes of concluding and performing a purchase-sale contract with you, we shall process your personal data so that you were able to purchase in our e-store (place an order, pay it, receive VAT invoices for the purchased goods and/or services, see the order details etc.), so that we could deliver the purchased goods or, in urgent cases (in the event of any problems concerning the order), so that we could contact you by phone.
    Your e-mail and phone number shall be processed for the purposes of notifying you of the status of your order, expected date of delivery, sending of interim confirmations, for example, a confirmation that the payment has been received, payment documents (VAT invoice etc.) and identifying you when you place enquiries concerning your order to us. Furthermore, your personal data shall be processed for statistical purposes as defined in Paragraph 1.3.
    In order to purchase in the e-store, you must accept the terms and conditions of the purchase-sale contract and provide your personal data. If you do not accept the terms and conditions of the purchase-sale contract and fail to provide your personal data, you cannot purchase in the e-store.
    If you order goods and/or services in the e-store for another person or in the name of another person, you must notify the person and obtain the person’s consent to provision of his/her personal data to us and ensure that the person has understood and familiarised himself/herself with this Privacy Policy. The afore-mentioned information of the other person shall be used as provided for in this Paragraph.

    1.3 Statistical analysis

    Categories of personal data: Country, gender, city, language, list of favourite goods, list of orders in the e-store, data of returns.

    Legal basis for the processing: Our legitimate interest, which means collection of statistical data and preparation of reports required for the purposes specified below.

    We also process your aggregated personal data by automated means for statistical purposes, for instance, we analyse what goods were added to the list of favourite goods since such details help us have a generalized overview of KIMKO customer, to determine market strategies, and once we know the needs of our KIMKO customers – to improve the KIMKO products and services. Actions of statistical analysis have no legal or any similar significant effect.

    1.4 Direct marketing

    Categories of personal data: Name, phone number , e-mail, tracking interactions of e-mail (information if a newsletter was read, when it was read, how many times it has been read (or opened), if it has forwarded, what operating system was used, which email server, including its location).

    Legal basis for the processing: We are processing personal data for direct marketing purposes based on your consent, also based on our legitimate interest to offer products and/or services that better meet your needs we are doing profiling.

    If you give us a consent in our web-page to receive direct marketing offers we are sending by e-mail information about our products, services, offers & promotions, a notice of the goods which are on sale again and a notice of the basket of goods left in the e-store.
    If you send a notice of the goods which are on sale again from the e-mail of another person in the e-store, you must notify the person and obtain the person’s consent to provision of his/her personal data to us and ensure that the person has understood and familiarised himself/herself with this Privacy Policy. The afore-mentioned information of the other person shall be used as provided for in this Paragraph.
    Sometimes we could invite you to special events or ask you to participate in surveys, e.g. which items you prefer, why you buy this or that item, or how your dream home looks like. We do that to learn more about your preferences and to better tailor our offerings to your needs. This information is purely voluntary and you are not obliged to answer these surveys or participate in the event.
    If you agreed to receive direct marketing offers by e-mail in order to better understand if information we send is relevant to you we track interaction of newsletter (information if a newsletter was read, when it was read, how many times it has been read (or opened), if it has forwarded, what operating system was used, which email server, including its location).
    You can unsubscribe from direct marketing offers in KIMKO account, by clicking unsubscribe link in e-mail or contacting us by below mentioned contacts.
    By registering for a direct marketing offers, you confirm that your personal data is accurate and correct, and you are at least 18 years of age.

    1.5 Delivery of goods

    Categories of personal data: Name, surname, address (including the door code), phone number, order date and number, signature.

    Legal basis for the processing: We process personal data in order to sign an agreement on delivery of goods and fulfil it.

    We process your data in order to fulfil your order of home delivery of goods as well as label packages of all ordered goods by specifying the address to make sure all of the goods are successfully delivered to you.
    We receive your personal data when you submit your order of home delivery of goods.
    If you order the service of home delivery of goods, you must provide your personal data. If you fail to provide it, we will not be able to fulfil your order.
    We transfer your personal data to our partners, i.e. companies providing home delivery services that deliver goods directly to your door.
    Your personal data shall be stored for 10 years from the date of order fulfilment.

    1.6 Replacement and/or return of goods, refund

    Categories of personal data: Name, surname, phone number (optional), bank account number (in case of refunding to a bank account), signature.

    Legal basis for the processing: Your personal data are processed subject to our legal obligation.

    We process your personal data in order to ensure your right to return and/or replace goods in accordance with the laws and internal procedures, as well as to carry out refunds to your bank account in such cases when you e.g. overpay for our goods etc. Your contact information is processed, so we could contact you, if needed (e.g. when you provide us with incorrect information).

    You must provide your personal data, so we could return and/or replace goods in order to make refunds to your account. If you fail to provide the data, we shall not be able to ensure your right to return and/or replace goods, nor shall we be able to make refunds to your bank account.
    We receive information about you once you fill out an act of replacement and/or return of goods or a refund request. Also, in such cases when you contact companies providing home appliance warranty services, these companies provide us with your personal details, so we could contact you and make refund or deliver a new high quality home appliance to a company providing home appliance warranty service.
    Your personal data present in the act of replacement and/or return of goods or a refund request shall be stored for 10 years. Personal data received from companies providing home appliance warranty services shall be stored for no longer than 1 year.

    1.7 Addressing enquiries, requests, suggestions, notes, complaints, requirements and feedback

    Categories of personal data: Name; surname; address; E-mail; phone number; description of complaint or other request; documents supporting the complaint that aside other personal data may also include health data given that the request is related to a compensation for damage as a result of health impairment; purchase history.

    Legal basis for the processing: Your personal data are processed subject to our legal obligation to respond to your queries in accordance with the Law on Consumer Protection of the Republic of Lithuania, and based on our legitimate interests to make sure that your complaint or other request is legitimate as well as to analyse it, while we process personal data of special categories in order to declare, fulfil or protect legal requirements. Personal data may also be processed based on your consent.

    We process your personal data, so we could evaluate and address your enquiries, requests, suggestions, notes, complaints, requirements, feedback, as well as to make sure that they are reasonable and to provide you with an answer by also seeking to declare, fulfil or protect legal requirements.
    In the case of complaint you must provide us with your first name, surname, contact information, complaint description and documents supporting legitimacy of your complaint. If you fail to provide the mandatory information, we shall not be able to evaluate and address your complaint. We allow you to choose whether you want to receive an answer to your enquiry, request, suggestion, note, complaint, requirement or feedback, and in what way you want to receive it, therefore specify your phone number or email e-mail based on your preference. If you fail to provide the specified information, we shall not be able to answer you.
    We receive your personal data once you provide us with the aforementioned enquiries, requests, suggestions, notes, complaints, requirements or feedback by mail, via email, through the call centre phone line, our Facebook account, public space, contact us page on our website.
    We may transfer your data to an insurance company. Also, in such cases when you submit request regarding missing parts of goods, subject to your separate consent, we may transfer personal data (first name, surname, address, postal code, phone) to manufacturer of good, so that the manufacturer could send the missing goods directly to you.
    All the personal data related to complaints being addressed or submitted enquiries, requests, suggestions, notes, requirements or feedback shall be stored for no longer than 1 year from the date of their settlement. Personal data may be stored longer if settlement of a complaint or enquiry, request, suggestion, note, requirement or feedback fails or is still in progress, also if personal data is required in order to protect our or any third parties’ legitimate interests, e.g. for the period of statutory limitation or in case of a legal dispute. If a complaint is to be settled by signing a peace agreement, your personal data shall be stored for 10 years.
    Your personal data present in the act of replacement and/or return of goods or a refund request shall be stored for 10 years. Personal data received from companies providing home appliance warranty services shall be stored for no longer than 1 year

    1.8 VAT invoices for acquired goods, services

    Categories of personal data: : Name; surname; address; VAT payer code (if you are a registered VAT payer); code of an individual company or number of business certificate or self-employment certificate.

    Legal basis for the processing: Your personal data are processed in order to fulfil our legal obligation.

    We process your data, so we could ensure fair fulfilment of tax obligations, correct invoicing of accounting documents and declaration of good acquisition to state institutions, as well as we can invoice you and administer accounting documents, e.g. VAT invoices, credit VAT invoices.
    We receive information about you when you provide it to us, so we could provide you with a VAT invoice for the acquired goods, services, and a credit VAT invoice for returned goods.
    You must provide us with your first name, surname, address, VAT payer code (if any), code of individual company number of business certificate or self-employment certificate. Such personal data is required in order to correctly invoice documents as well as to declare acquisition of good to state institutions.
    If you fail to provide your personal data, we shall not be able to invoice you accounting documents and declare your acquisition of goods to state institutions.
    Your personal data shall be stored for 10 years from the date of acquisition and accounting document invoicing.
    We transfer your personal data to state institutions (tax institutions mostly) and auditors.

    1.9 Customer service quality surveys

    Categories of personal data: Name; surname; E-mail; phone number, order date and number.

    Legal basis for the processing: Personal data are processed on the basis of your consent.

    We process your personal data in order to be able to conduct surveys on the quality of customer service, including our services. We conduct these surveys in order to improve our services and customer service quality.
    Your personal data shall be used for the purpose of customer service quality surveys (direct marketing) for 3 (three) months counting from the end of the calendar month when the consent was given.

  3. HOW DO WE COLLECT INFORMATION ABOUT YOU
  4. We obtain information about you when you create or use your KIMKO account, use the e-store services, please contact us, subscribe a newsletter.
    When you pay in the e-store, we receive your payment details from the bank.
    We may also receive your data from the user of the e-store where he/she orders goods and/or services in the e-store for you or in your name, sends a notice of the goods which are on sale again by email with your consent.

  5. HOW LONG DO WE KEEP YOUR PERSONAL DATA
  6. Your personal data in KIMKO account (including direct marketing for KIMKO account holders) will be stored 5 years from the last login or till the date when you decide to delete the account.
    Details of e-mails, for example, when you created an KIMKO account on the website and we sent confirmation e-mail or requested to remind the forgotten password or send a notice of the left basket of goods, shall be stored for the following period: content of the e-mail – for 72 hours, the recipient, title of the e-mail – for 15 days.
    In cases where you request so send a notice of the goods which are on sale again in the e-store, your personal data shall be stored:
    1) not longer than 3 months if during the afore-mentioned period the goods are not on sale against and no notice was send;
    2) the content of the e-mail shall be stored for 72 hours and the name of the recipient and e-mail shall be stored for 15 days from the date of sending the first notice.
    The personal data contained in the purchase-sale, payment documents (VAT invoice etc.)shall be stored for 10 years.
    Data for the purposes of statistical analysis will be stored for the same period as the data of KIMKO account data.
    Personal data for direct marketing in web-page will be stored as long as you want to receive direct marketing from us.

  7. TO WHOM PERSONAL DATA ARE DISCLOSED
  8. We disclose your personal data to:

    a) Companies we work with. The personal data shall be disclosed to companies that provide services to us i.e. our data processors, i.e.:

    1) To IT maintenance companies, IT support companies, companies which provide IT systems.
    2) To the company which provides direct marketing newsletter sending.
    3) To the company which provides e-mail sending services.
    4) To the company which is providing SMS centre services.

    These companies are required to adequately safeguard your personal data and not use them for any unauthorised purposes and to ensure that its suppliers do the same.

    b) Other

    In case of dispute we transfer your personal data to legal advisers. Furthermore, when you purchase in the e-store and choose delivery to the home address, we shall transmit the personal data necessary for delivery to the companies which deliver the goods ordered in the e-store. When you settle accounts in the e-store, we shall transfer your personal data in relation to the order to the bank and the technical service provider of the payment portal.

    c) State and local government institutions, other persons performing functions assigned to them by law.
    We transfer your personal data to state and local government institutions and other persons performing functions assigned to them by law upon their request or in order to meet our legitimate interest in establishing, claiming and defending legal claims.

    d) We may disclose your personal information to any entity in our group (including our subsidiaries, our controlling entity, and all of their subsidiaries).

    The recipients of the data specified in this part may also be established outside the European Union or the European Economic Area. We will only transfer your personal data to persons who comply with the requirements set out in the General Data Protection Regulation.

  9. PROTECTION OF PERSONAL DATA

    We use a variety of technical and organisational security measures to protect your personal data from all kinds of threats: destruction, loss, alteration, unauthorized disclosure or access. Your personal data are stored safely and are only accessible to a limited number of persons.

    a) the right to access - you have the right obtain from us confirmation as to whether or not we process your personal data and, where we do, access to the personal data. That’s why we inform you in advance about our processing activities via this privacy policy. If you have any questions, or would you like to learn more about what information we process from you, you are always welcome to contact us and we will provide you with further information;
    b) the right to rectification - you have the right to request that we correct any inaccurate personal data. Also You can correct your personal data in KIMKO account;
    c) the right to erase - in some circumstances you have the right to the erasure of your personal data, if you believe there’s no longer any need for us to keep it. Or, if you previously have given your permission, you can just decide to withdraw it. This does not apply if where processing is necessary for exercising the right of freedom of expression and information, for compliance with a legal obligation or for the establishment, exercise or defence of legal claims;
    d) the right to receive yourself or transfer your personal data to another company in certain circumstances (known as the right to data portability). This applies when data processing is based on you consent or on a contract and where processing is carried out by automated means;
    e) the right to restrict - in some circumstances you have the right to restrict the processing of your personal data. This means we will continue to store your information, but we’ll temporarily stop any other processing. Why would you want to do this? For example if you’ve asked us to fix incorrect information. In this situation you may want us to stop processing until the information is correct;
    f) the right to object - you have the right to object to our processing. This applies when data processing is based on legitimate interests pursued by us or by a third party. You can do this when you believe that your personal interest outweighs ours;
    g) the right to object - you have the right to object to our processing of your personal data for direct marketing purposes, including profiling;
    h) the right to withdraw your consent to the processing at any time.

    You also have the right to make a complaint to the State data protection inspectorate if you believe that the processing of personal data by us does not comply with applicable legislation.
